Asset Protection Planning
Estate planning is all about asset protection. The process of estate planning and administration raises questions, causes conversations, and leads to your making decisions that reflect your goals.
Is probate always required? Can I preserve assets in a living trust? If you want answers to these and other questions, contact Caldwell Law to start your personal discussion.
Caldwell Law's Approach to Asset Protection
Caldwell Law's Traditional Estate Planning process focuses on achieving your present estate planning goals based on current laws and tax codes and the current situation in your life.Caldwell Law's Lifeplan™ process involves all the same steps of the traditional process, but goes beyond that to include an ongoing method for keeping up with new laws and tax codes, and your evolving life situations that affect the plan's ability to achieve your goals.
In other words, the Lifeplan™ process helps clients make their plans strong and rock-solid as life progresses.
Our clear, easy process:
- An Introductory Meeting helps you get to know us and gain a general understanding of the services we offer for each process.
- We offer free Workshops that provide overviews of the essential, from both the practical and legal perspectives of asset protection.
- For those who do not wish to attend the workshops, Private Consultations for a reduced price may be scheduled.
- The next step is the Design Meeting in which a specific plan is developed to achieve your goals.
- Following the Design Meeting is the Review and Signing Meeting where the plan is reviewed, discussed, tweaked, and signed.
- The final step involves the tasks of Titling, Funding, and other legal work involved in asset protection. This step - a critical and often overlooked aspect of planning your estate - is necessary to align your assets with your plan.
What does asset protection mean to you?
Which is better - wills vs trust? Can I set up a special needs trust? Who should consider asset protection? At Caldwell Law, you ask the questions, we answer.
Here's What One Client Says About How to Avoid Probate
"I, and I suspect many others, am resistant to getting into the details of my coming demise. However, as the years have gone by, I have felt a rising guilt about failing to shoulder some of the responsibility of taking care of my family. Tim is someone who has gotten into all those details of dying. He knows in which situations he can advise me and when he must force me to decide. He knows when certain issues are in the mutual interest of my wife and me, and also when our interests are in opposition ... and he provides an atmosphere in which such things can be discussed openly.
It is easy, both with the rapid changes in the law and the changes in my life, to have the title to things be wrong for avoiding probate or for the beneficiaries of my modest wealth to become inappropriate for one reason or another. The Lifeplan™ arrangement developed by Tim allows his staff to keep after me, and keep things up-to-date as my circumstances change with time.
On the lighter side, if there can be one in the business of wills and estates, there are regular meetings with friendly people, free concerts with free food, and free advice from various speakers about topics a bit broader than where all the stuff goes when I die."

Here's What One Couple Says About a Revocable Trust and a Living Will"With Caldwell Law, you are not treated like a client; you become a member of the family. My wife and I started working with Tim and Tracy seven years ago, putting together an estate plan with revocable trusts, living wills, medical powers of attorney, and end-of-life care documents. All this was accomplished with speed and efficiency, around my wife's schedule of chemotherapy treatments. In 2007, we updated these documents in just two meetings. At Caldwell's Annual Client Meeting in 2008, I learned we might have some shortfalls in how our trusts are funded, which were corrected in just a week's time, with Violet's help."
